About business with Indonesia - Part 2

I have experience in doing business in Indonesia since my wife owns a PT (Indonesian equivalent of Ltd. or Inc.) and we trade with my Netherlands based company regularly. As far as I know a CV (regional limited company) can't trade outside of its province, let alone import or export things. PD is local, CV is regional and PT is national/international. So is dealing with a PT a guarantee for good service? Certainly not. It totally depends on honesty of people. My experience tells me that businesses with a Chinese owner are more likely to be in it for the long term. The stereotype Indonesian businessman/woman will rather take $100 today then $1000 tomorrow and the mentality in the country is "you paid before you got the goods or service? Tough luck!". Quality is another issue as many traders will rather ship you rubbish on a trial order for that quick buck then provide quality to guarantee a long term business relationship. Going to Indonesia to take care of business is also not the way to success as you will get scammed by many as soon as you soften up for a moment or turn your back for a second. Don't get me wrong here as I love the country and I think the people are geberally very friendly and hospitable but business brings out the best and the worst in people. Micro-manage everything and don't let any part of your business be run by anyone except a trusted friend or family member in Indonesia is my advice. It's how the Indonesians do it themselves also so there is a good reason for it to be the way it is...
PT can only export with an export license. In practical terms this can be avoided or arranged by bribing the right official (in Indonesia almost everything can be bought for the right price) so it's not a guarantee either but why not ask for a copy of their export license? If they have it they spent at least a certain amount on geting it and the chances are higher that you deal with a legitimate company. I have been ripped off in Indonesia but I have also found many trustworthy people there. So please don't see all of this as a gloom and doom sort of story. Problem with Indonesia is that it's isolated and doesn't actively enforce legislation that's in place. Your rights as a consumer and trader are not as well protected yet as in other countries. Still if you want the lowest price then go to China as Indonesia can't compete (nobody can actually) with them. To get electronics from Indonesia is ridiculous as they import it from China and Singapore themselves. Anyone selling at a lower price then in China must be either stark raving mad or a scam artist.

There are thousands of (Indonesian) companies listed at alibaba.com. How many of them are legal businesses and how many is scam?

I can say that most of the businesses are decent and honest companies who are using alibaba to create customer contacts. So how is it possible that roughly 95% of the registries is scam?

The 95% are all leading to the Indonesian Internet Mafia. Well organized crime with connections to banking, military and (local) government officials.

How it works;

An Indonesian programmer earns 2 dollar per day. A group of programmers (100+) are working round the clock, setting-up websites, posting trade-leads etc. Everything is leading to the middle-man who also works at one of the thousands internet cafe's. This guy is answering your email or (if there is) phone.

Let say every programmer post 3 leads per day 100*3*365 = > 100.000 per year. 1% gets response and 1% of those who responding pay an average from $1000.= Income for the syndicate >$10,000 per day. A profitable business without any risk.

What they after is your money especial the small amounts. Who is going to Indonesia to recover $2000.=? Would you?

But what if you live around the corner? At least I will have a look before I buy I would say. Also for Criminals counts the same rule "good business is avoiding unnecessary risk. Why replying to someone who is going to check before he buys? Waste of time and risky. It's better to concentrate to people who are far away.

Don't bother trying to import authentic brand clothing from China.

1. My company is an agent for an authorized resellers in Italy. They have 14 boutiques in Italy, Austria, Spain. They buy extra to wholesale world wide, this is how they can obtain sanitized invoices from the designer houses.

2. The terms and policy on my web site is the authorized resellers' terms and policy in Italy, I did not specify this on the site and it is causing confusion as to why my company is located in the US and yet payment is made directly to Italy, this is becuase I am their agent. I do not accept payment in the US. Due to many requests from US customers, we are stocking some items in the US for customers who wants to try out a small order before buying from Italy or customers who already are buying from Italy and want to supplement their inventory. My company accept credit card only. If I sell fakes, I will ask for a money order.

3. The average wholesale price of a small Gucci handbag, comestic bag is USD 150, medium Gucci handbag is USD300, all leather Prada is USD 400. We do not have any authentic designer handbag for USD 25. The cheapest item is Gucci key chains, USD 50.

4. My phone no. is a land line, not a cell phone. You can call and find out.

5. AOL was not free until this year. I have been using AOL before there was high speed broadbrand and have to pay for dail up by the minute in the 80's. I was paying $24.50 a month until AOl decided to switch it to free like yahoo, hotmail, etc. Even though I do not have to pay right now, I still get technical support from AOL. For people who signed up for free AOL this year, they do not get technical support.

6. I resent being acused that my company is a bridge to an Italian counterfeiter.

I hate fakes and do take responsibility, provide customers service, answer many questions, even questions on how to measure a handbag, how to write description for the handbags, how to sell the handbags. I do not have to answer many of these questions because it is not my job to teach customer who are new to this business how to sell their handbags, yet I do my best to answer all questions.

An agent is a full time job, it is not just sending in orders to Italy. It involves follow up to make sure customers are satisfied. If any customer is not satisfied with an order, refund is always given from Italy. The company I work with has been in business since 1989. If they sell fakes, they will not still be here today.

7. This is the definition of parallel import: Parallel importers ordinarily purchase products in one country at a price (P1) which is cheaper than the price at which they are sold in a second country (P2), import the products into the second country, and sell the products in that country at a price which is usually between P1 and P2.

If you think buying from the designer stores in Italy or the designer outlets at a 30% to 40% discount and ship it to the US is not parallel importing, you are wrong.

8. I do answer any question or inquiry in a very timely manner because the company I work with is an authorizied reseller of many designer brands. I know about the complexity of this business which many people do not know. For example, does any one know why there are 1 2 3 4 5 6 7 0 on a Gucci contrallato card, and if you look closely, there is a missing spot on one on the number, it can be any number. This missing spot makes the number looks as if it is not printed correctly.

How can I confirm that they are really a Nike authorization factory?

When asking one of my reasearched suppliers based in China, whether their products were authentic. I received the following reply:

"We are an authorization factory at China to produce Nike shoes and our shoes are original with top quality. After your first order I could provide you with the authorized letter for your reference''

What type of questions could I ask this company to confirm this is not a scam and that they really are authorized to produce original Nike shoes? As it appears a little odd that they say they will provide me with an authorization letter after the first order?

FYI, the Nike manufacturer in China only produces for the China market.
All Nike distributors are not in China. / for export that is.

Nike has a lot of contracted shoes manufacturers around the world, mostly in developing countries. I believe that the factory you are contacting could be one of those authorized manufactureres BUT not an authorized sales/export channel. You should contact Nike or their subsidaries though they pricings would have kill the business before it start.

Very eash, verify with Nike head office. Actually, after your message I would expect them to interfere and confirm if they have a plant in China. Most of European factories have plants in China, this is correct.

It's hard to determine whether or not a factory is authorized by Nike. I was scammed by a factory just recently saying their shoes were authentic and even showing me a letter from Nike stating it was so. Upon arrival of the goods here in the USA, it was confirmed by myself and several colleagues that the shoes were fakes and of poor quality.

I just want to make this posting so that others don't get scammed by this company as I have. The company name is www.Ruceo.com. They solicited business through eBay illegally by sending a generic email announcing that they sell electronics with very low prices. Once at their website a fellow by the name of Ren Guo Fan in Beijing, China (supposedly) gives you a price (very low) and states that you must either wire money to 'his' bank account or Western Union. At the time I was very naive and fell for this scam. I never received any products just requests to send yet, more money and now I am out $2,000.00.
Hopefully, not another person will fall for scams like www.Ruceo.com and Ren Guo Fan have pulled off. Don't Buy Anything From www.Ruceo.com or Ren Guo Fan in Beijing, China and NEVER use practices as Western Union which has no tracking system or protection for the consumer!

Non reciept of goods. I ordered 10 Sony Playstation 3 game consoles. I was told they were the U.S. Version at a price quoted of $390 USD for each unit. I recieved an Invoice No. 326568800 from HeddaDigital dated 10 April with payment information for TT payment. I sent the money by wire transfer on 04/10/07 from my bank (CHASE)and they (HeddaDigital) provided me a tracking number for the shipment, the shipment was VIA EMS Worldwide Express Mail service (China Post). Tracking number provided was EA822782164CN. Shipping date was 04/17/07. The shipment arrived on 04/23/07 and it was a China Post letter envelope containing a foam rubber picture frame. Nothing else in the package. I talked to my salesman who has since quit the company, the money was transferred to his personal account, then turned over to his manager. He told me that they are a fraudulant company. They recieve money for goods and do not ship them. He told me that they switch physical locations frequently, as well as changing telephone numbers. He stated the employees also use fake names. They typically request Western Union payment. The wire transfers are sent to individual employee accounts, not to a company account to eliminate a paper trail to the owner. He would not disclose the other company employee names to me, or the physical address of the company, or even verify the phone number that is on the web site.
I have since notified the U.S. FBI, and am in the process of Notifying the Chinese Consulate in the U.S., in addition to the Shenzen Police Department.

How To Protect Your Company From Bad China Product

We have received many e-mails from readers and phone calls from clients regarding issues arising from the recent melamine pet food tainting. We not only represent a number of companies involved with China food, we also represent many importers of Chinese manufactured products who constantly encounter quality and safety issues. To assist our clients, we developed a checklist/audit program to minimize and reduce risks associated with the health and safety issues arising from bringing Chinese products into the West.

This post is a portion of what we tell our clients and it is intended to set forth some of the things that you, as a Western business involved in China, must do to minimize the likelihood of your product harming people and to minimize your liability if, after doing everything you reasonably can to prevent a problem, such a problem occurs. Our basic theme is that when you purchase products from China you must take action to ensure the safety and quality of your product; you cannot rely on the Chinese side to do these things.

Dangerous Chinese products were entering the United States and Europe long before the Melamine pet food tainting hit the news. But that incident and those which quickly followed it (bad toothpaste being the most prominent) mean everyone is now on notice these issues are real. From now on, it will be impossible for any Western company to plead ignorance. Western companies that refuse to take proper action will increasingly be subject to to severe penalties, even including punitive damages, where such damages are available. In other words, any Western company that does nothing to assure the safety of its Chinese products and then steps into court claiming it had every reason to trust its Chinese supplier (based on faith alone), is likely to face real anger and major damages. Plaintiff's class action lawyers in the United States should be and are salivating.

And get this straight, we are not just talking about food products here, though that is the most obvious and prominent right now. If you are selling Chinese bikes, do you know whether the nuts on your seats are really strong enough to withstand a 200 pound Westerner? If you are selling Chinese electrical goods, do you know if that Underwriters Laboratory (UL) sticker is counterfeit or not? Is the plastic in your Chinese made baby item really nontoxic? Will your cigarette lighter explode? Are you certain the fake fur on your coat is not from a dog? The time for complacence is over.

Liability for damages caused by defective Chinese products is going to be huge and it is going to be vast and it is going to fall disproportionally on American and European companies. The reason for this is twofold. First, it is viewed as difficult and expensive to sue Chinese manufacturers. Second, and more importantly, Chinese courts do not give large damage awards, so the result of a tort suit in China is not likely to be attractive to U.S. and European plaintiffs. Therefore, there will be overwhelming pressure to file such suits in the United States or in Europe, with the importer and retailer as the defendants. Based on our experience in the United States, such suits will likely be heard by U.S. courts and damages will be awarded.

We recommend Western importers of Chinese goods take the following actions:

1. Know Your Chinese Suppliers. Chinese suppliers run the gambit from superb to good to mediocre to criminal. We advise our clients to thoroughly check out any potential supplier in advance. For a recent client we developed the following plan for a supplier audit. We will be retaining investigators that will make sure our client is (and will be) dealing only with high end Chinese suppliers. We will begin with a credit check. Such a check can usually be done for less than $1500 and they are often quite revealing. Among other things, such a check can reveal whether the Chinese company with whom you have contracted is in fact the factory owner, or just some broker posing as the factory owner. Does the factory pay its bills? A thriving company is far less likely to risk its reputation by cutting safety corners to save a few Yuan than a company on the verge of going under. The credit check may also reveal other Western companies to whom the Chinese company has been supplying product. What do these Western companies think of this Chinese supplier? Learning that a well regarded Western company has been purchasing product from the Chinese factory without major problems for the last five years is obviously a good sign.

2. Quality Control. It is absolutely essential the Western purchaser of Chinese product take responsibility for quality control. Most Chinese products arrive in the U.S. or Europe already packaged for retail sale, making inspection outside China cost ineffective. In these situations, a statistically valid inspection system within China is critical for proving out the safety and quality of the product. For food and drug items, the Chinese government has its own effective inspection system, but to reduce costs, many Chinese suppliers intentionally avoid the Chinese government procedures. The Chinese government itself estimates as many as 50% of the food and drug items exported from China violate China’s own export rules. It therefore becomes your job to make sure your Chinese supplier is licensed both to manufacture the product you are buying from it and licensed to export it. It is also your responsibility to make sure the product you are buying went through proper Chinese government inspection before export.

3. Contracts. All contracts with Chinese suppliers should focus in detail on safety and quality control issues. It is frankly shocking to us that many importers of product from China not only do not have a contract dealing with quality and safety issues, they have no contract whatsoever. Such businesses are simply asking for trouble under the U.S. legal system, and presumably in most European countries as well. Your contract with your Chinese supplier must be clear and specific as to quality expectations. If your product calls for 12% stainless steel, your contract should clearly state 12% stainless steel is required and anything else is completely unacceptable. The contract also must make clear your right to inspect and it should delineate responsibility for injuries and recalls. Equally important, you must do what the contract provides. If the contract states you are responsible for inspection, then you must actually inspect. The contract is not there for show: it is there to provide a procedure to be followed.
Your contract with your Chinese manufacturer can serve either to shift liability towards you or away from you.

At the same time, however, you must recognize U.S. Courts are likely to be reluctant to see an injured party walk away with nothing. Therefore, no matter how good your contract is at deflecting liability from your company, you must still not abandon your other protections.

4. History. If you have been using five suppliers for the last few years and four are good and one is problematic, dump the worst one as soon as possible. It seems every time my firm is called in to deal with a major supply problem our client says something like, "we should have known we would have a problem with this supplier." You know who your problem suppliers are and you need to replace them now before they cause even bigger problems. Ask a product liability defense lawyer whether having to deal with a bunch of e-mails from you to your supplier complaining of "continual quality shortfalls" is going to be good for your product injury lawsuit. Actually, don't bother, you know the answer as well as they do.

5. Insurance. Insurance is NOT a replacement for the above, but it is your backup. Insurance almost never covers more than your legal fees and out of pocket damages. It will not cover your time spent defending lawsuits nor will it cover your damaged reputation. Make sure you know your own situation (for example, are you a manufacturer or not?) and make sure your policy covers your situation.

6. Marketing. I represented a company whose product brochure sported a cover claiming it made the "toughest" product in the industry. Every time something would go wrong with that product (which typically cost around $250,000), the opposing lawyer would argue my client should be held to a higher than normal standard because it had expressly warranted its product to hold up better than its competition. Make sure you are not making claims about your product you cannot back up. For example, many U.S. importers claim their Chinese manufactured product is manufactured to an international standard that simply is not followed in China. Things like this just give the plaintiff's lawyer more ammunition against you in any legal proceeding.

There is obviously a lot more to protecting your company from dangerous China product than just abiding by the items we set forth above, and many of the things you do to protect yourself will be industry and company specific. But, at minimum, every company getting product from China should be reviewing at least these aspects of its business.

Alibaba.com is a Hong Kong based online business-to-business commerce and auction company that has developed into a substantial resource for both Asian businesses and Western corporations. Originally designed to connect Chinese businessmen with Western buyers, Alibaba manages a bilingual format that both Chinese businessmen and English speaking businesses can use to execute trades.

It is a straightforward wholesale marketplace, where member vendors can display wares and prices. It also operates the premiere Chinese auction site, an Asian version of eBay called TaoBao.com. Alibaba dominates the Chinese ecommerce market and is a major player for some import-export markets on an international scale.
In recent years, the company has aggressively expanded its sophistication and service array. In 2005 Yahoo bought 40% of Alibaba for one billion dollars plus all of Yahoo's Chinese assets. Alibaba founder and entrepreneur Jack Ma has since then redesigned Yahoo's Chinese portal and attempted to market it as the definitive Chinese search engine. Alibaba has also developed an online funds transfer system with a Hong Kong bank, attempting to establish a tool similar to PayPal.

Recently the firm released a survey claiming to prove that product sourcing online through Alibaba.com can cut the normal sourcing cycle by 75 percent. Alibaba.com members say it takes about three weeks to find the right trading partner and negotiate a deal through the Web site, compared to the average sourcing cycle of 3.3 to 4.2 months.

The survey found that 56 percent of Alibaba.com members take two to four weeks to negotiate the terms of a purchase or sale from first contact to finalized contract agreement, while 17 percent say it takes them no more than a week. The survey was conducted from June 19 to July 9, 2006, and included responses from more than 1,100 Alibaba.com members.

Alibaba claims that it is the simplest and most effective way to find products and resources. Their membership base has reached the point (1.2 million members) that both Chinese and Western entrepreneurs wishing to engage in product sales can no longer ignore this enormous marketplace. ''We reduce the sourcing time by bridging geographies and time zones and putting thousands of products and suppliers in one easy-to-use location," said an Alibaba VP for operations.

Both Alibaba and TaoBao currently do not charge fees from buyers or sellers. That has force eBay to change its business model in China as well. Alibaba has a "premium" service that it provides to members who wish to sign on; indications are that TaoBao will adopt a fee structure at some point.

It appears that partnership with an indigenous corporation is important. Google's efforts in China are relatively recent. Yahoo has made its presence there a success by effectively turning its operations over to Alibaba. They won the battle with eBay in Japan by partnering with Softbank, a Japanese conglomerate. So while the Yahoo auction site is inconsequential in the U.S. it forced eBay out of the market before they could get started.

These are critical times for the major web players in China. Less than ten percent of China's populace has web access - however those early adopters amount to one hundred million people and many of them are businessmen. In ten years, China may be the biggest economy - online and otherwise - in the world. Alibaba has done an excellent job of staking out its domestic turf and joining forces with the entrenched Yahoo in America and Europe. They'll give Google and eBay a run for their yen.

With China's economy still at high speed and corporate profits and wages on the upswing, this should be a golden time to be a newly minted university graduate. After all, multinational corporations have been complaining that they can't find enough qualified people to hire. Factories along the coastal regions have been hit by a shortage of migrant workers.

But guess what? For college seniors graduating this spring, finding a job has been a real struggle. There are simply too many of them to absorb even for a growing economy like China. Just ask Yang Hanning, who will be graduating with a degree in computer science from Tianjin University of Commerce in July. He has sent out dozens of résumés and been called back for an interview for fewer than 10 companies. He has yet to receive a job offer.

"All of the jobs I've applied for are looking for people with experience. They give us recent graduates the cold shoulder," Yang, 23, laments. In fact only three out of his 22 classmates in the computer science department have received job offers so far, and none of the jobs has anything to do with their major.

Cutthroat job market

In 1977, the first year that Chinese university enrollment resumed after the trauma of the Cultural Revolution, only 4.7% of applicants, or 270,000 students, were accepted into college; a carefully managed trickle. And those lucky kids generally coasted into a stable job in a government ministry or state-owned enterprise. It was the fabled era of the "iron rice bowl" in which college grads received subsidized housing and rock-solid job security.

China's evolution since then into a more market-driven economy has also meant a far more cutthroat job market. This spring, 4.95 million seniors will graduate from colleges across China, nearly five times as many college graduates than China produced seven years ago.

"There are a lot of people in China. Everybody has a college degree and they're all competing for that one opening," said Liu Chao, 21, who will be graduating in July with a degree in computer science from Beijing Information Technology College. The joke floating around college Internet chat rooms is that college students nowadays are like cabbages: There's an abundant supply of them and their price never goes up.

Flood of unemployed

The reason universities are churning out record numbers of graduates every year is rooted in the Chinese government's decision to expand university enrollment starting in 1999. With the Chinese economy slowing during the Asian financial crisis, Asian Development Bank economist Tang Min in 1998 proposed expanding university enrollment to boost domestic consumption. China was closing down state-owned enterprises and laying off millions of workers at the time, so it seemed like a good idea to send some of the 3 million high school graduates in 1999 to college and delay their entry into the job market.

Today it is unclear exactly how many recent college graduates are unable to find a job. Since 2001, the official figures from the Ministry of Labor and Social Security (MOLSS) claim that roughly 30% of college seniors have not signed an employment contract by the time they receive their diplomas in July, which is a typical number for the U.S. and other developed nations. In China, however, that would mean nearly 1.5 million recent graduates will be flooding the job market this summer.

"The MOLSS tabulates the unemployment figures for blue collar workers and doesn't really care about white collar unemployment. College graduates are white collar. The MOLSS doesn't know how many of them are unemployed and doesn't care," said Yao Yuqun, professor at Renmin University's School of Labor Relations and Human Resources. He added that unemployed college graduates are not counted in China's official 4.1% unemployment rate.

Spoiled only children?

However there is anecdotal evidence to suggest that it is a growing problem that has attracted the government's attention. Last November, a graduate student from the prestigious Tsinghua University committed suicide because he was unable to find work. Starting last year, college graduates who have been unable to find work by Sept. 1 have been allowed to register as unemployed with their local government offices and receive unemployment benefits.

Older Chinese complain that the current crop of college graduates born in the 1980s under the one-child policy have been coddled by their parents. Unlike their parents who dutifully went to work wherever the state assigned them, this generation of Chinese are pickier about where they live and where they work.

"Some college graduates will only work if they find a good job. If it's a regular job, they won't do it," noted Sun Baohong, head of the Shanghai Academy of Social Sciences' Institute of Adolescents.

Please stay home

College graduates expect to land nice white collar jobs after graduation. The reality is that China's economic growth is still largely driven by factories needing cheap, low-skilled workers churning out products for export. Hence, chief executives complain that they receive a mountain of résumés for administrative positions but are having a hard time filling openings on the plant floor.

Most college graduates have also shunned the countryside and flocked to China's major metropolitan areas, such as Beijing, Shanghai, and Shenzhen, to find jobs. The government has been trying to entice college graduates to spend a year or two working in rural areas after graduation by giving them bonus points if they apply to graduate school later. But young Chinese say that one reason they prefer to go to major cities to find work is because they feel the playing field is more level there, unlike in the countryside where "guanxi" or connections are needed to find jobs.

Companies say that China's educational system, which stresses rote memorization, turns out college graduates who can perform repetitive tasks efficiently but cannot think "out of the box" to attack problems creatively. Often college graduates simply can't do jobs they are hired for without further post-graduate training.

Experience worth the price

A European startup working on applying artificial intelligence to business cases moved its research and development operations to Beijing last year to take advantage of the cheap cost of Chinese software programmers and found this out the hard way. It originally posted job advertisements on the Internet and hired seven recent college graduates only to discover that some of the programmers were unable to write simple computer programs.

In February the company decided to start over from scratch. This time it hired a headhunter to find programmers with 5 to 10 years of experience. Even though it costs up to 10 times more to hire experienced programmers, as opposed to hiring fresh college graduates, the decision turned out to be worth it. "Of course the salary is different but you don't have redo their work and the work is higher quality. They would probably be actually cheaper than hiring fresh college graduates," said Nicolas Piguet, co-founder and R&D manager of the startup.

To be sure, many recent college graduates are aware of their shortcomings. They cite training and room for career advancement as one of the main factors when choosing where to work. "A lot of companies neglect career training. I don't get the feeling that I would learn a lot at these companies," said Jia Zhanjie, 24, who will be graduating with a degree in chemistry from Beijing Normal University. Even though he already has a job offer, he was still trolling job fairs on the weekends to see if he could find something better.

Limiting number of students

Not surprisingly, more and more college students are going to graduate school before entering the workforce. "After I return with my master's degree, it'll be easier to find work," said Luo Binhan, 23, who graduated with a degree in insurance from Wuhan University in 2005 and has taken the past year off to apply to graduate school overseas. However in the last couple of years Chinese students with graduate degrees have also found it harder to find work.

The Chinese government has started to take steps to improve the quality of education. The central government will invest 10 billion yuan ($1.3 billion) between 2006 to 2010 in vocational and technical schools to create more skilled workers. With factories facing shortages of skilled laborers, 95.6% of vocational school graduates had a job offer by the time they graduated last year.

Last year, the Ministry of Education also began to limit the number of incoming freshmen universities could accept to no more than 5% more than the year before. The rapid expansion of college enrollment had led to a shortage of qualified professors, leading to a drop in the standards. Renmin University's Professor Yao said, "A lot of people have been complaining to the Ministry of Education that their children can't find jobs. Expanding university enrollment has lost its attractiveness."

Due diligence is an absolute must if you plan to team up with a Chinese partner. It’s a jungle out there, so be wary. This is no place to cut expenses or rush through things because a half-done job may cost you twice as much time and money later. Due diligence is not a particularly prevalent practice among the Chinese and they may have trouble understanding why you are “making things difficult”. If your prospective partner refuses to cooperate, don’t be afraid to walk away.

There are three main types of due diligence that you need to concern yourself with – financial, legal, and environmental. Keep in mind that these three inquiries often overlap.

Financial Due Diligence

Many Chinese enterprises (it is said) have three sets of financial records: one for the
owners, one for the tax authorities, and one for foreign investors. Accordingly, determining the value of an enterprise based on its financial records can be difficult. It might be necessary to carry out an independent assessment of the enterprise’s reputation, connections, and key employees.

Key pitfalls to watch out for are:

Double-dealing employees – it is not at all uncommon in China for senior management to have their own businesses that directly compete with their employer, and for these executives to use their employer’s confidential information to further their own private interests.

Corrupt relationships with Chinese government officials – this presents the risk of civil liability or prosecution, not only by the Chinese authorities should things take a turn for the worse, but also by the US authorities if you happen to be American or otherwise subject to the US Foreign Corrupt Practices Act (some other nations have equivalent legislation; check your home jurisdiction if you are unsure).

Intellectual property piracy – rampant in China.

Legal due diligence

Legal due diligence focuses on a variety of issues including contract rights, corporate authority, regulatory compliance, ownership of assets, and liabilities and claims against the target company. Issues that often arise include:

Scope of business issues – At the minimum, you should authenticate and inspect an original of the enterprise’s business license (the scope of business is listed thereon).

Contracts – whether contractual arrangements are adequately documented (or documented at all).

Ownership of buildings and Land Use Rights – Check to make sure all buildings are owned outright and all land is “granted” rather than merely “allocated”.

Intellectual property – make sure that trademarks, etc. used by the target company are either owned by it or licensed to it.

Constitutional documents such as Articles of Association – make sure that they are up to date (properly amended to reflect the company’s current situation).

Construction permits and approvals – these should be examined not only for construction in progress, but also for existing structures

Labor disputes – determine whether there are any outstanding disputes, and the level of employee morale.

Debts and encumbrances – make sure that these are adequately documented and not excessive.

Environmental Due Diligence

In a nutshell, you need to know whether your partner’s site environment or your FIE’s proposed site environment has been contaminated (contamination of your Chinese partner’s site could affect its financial stability even if it is not used for the FIE).

Dangerous Chinese "Sellers"

One eBayer has already written a note about these but last night there was a spate of these crooks on eBay, mainly selling coins, totalling more than 100 items.

Experienced buyers often recognise these crooks but not always and the crooks are becoming more devious; so I have decided to write this guide to help you recognise these crooks and avoid financial loss.

Their current strategy is to create about 10 fake accounts, sell to these accounts and then create the illusion of a positive rating of 10. As far as payment is concerned, they used to use the Western Union trick - you can never get your money back - NEVER use Western Union. However, they are now using PayPal who will take no action to close these accounts - I know because I phoned them and they were simply not interested. So, you may or may not be covered by PayPal.

You should next look closely at what they have supposedly sold and then ask yourself whether it makes any sense that they are now selling a plethora of rare coins.

These listings are usually for one day only - a practice that a real seller would not use as it would limit the number of bids likely to be received. These crooks use this because eBay Safe Harbor is so hopelessly slow that the crooks do stand a real chance of succeeding with their theft.

Many of these listings also offer a ludicrously cheap Buy It Now option - again, you have to ask yourself "would a real seller need to do this?"

If bidding has got under way - often these crooks are so incompetent that the listing is laughable and is ignored by everyone - look at who is bidding and look at their track record from their feedback. Even knowledgeable people can get caught but generally, you will notice that the regular bidders are not bidding for these offers.

Sometimes these crooks manage to match their incompetence with their enthusiasm and you will see them offering the same rare item in several different listings!

Often a search for the item on eBay will also find you the original listing that was stolen by these crooks and you will be able to see from the photographs that these have been stolen.

If you are suspicious, you can always try to contact one of their so-called previous buyers and another technique is to ask for a new picture of the item. A real seller will invariably oblige.

As of today, 11 July 2006, the crooks are back and this time, they are using a zero rating instead of constructing 10 or so fake positives. My opinion now is that you should not buy coins from ANYONE in China who is not yet established and is showing a low or zero rating - there is almost certainly nothing there for you.

If you do discover this activity please help others as I do by telling them of the fraud, before they part with their money and also pester eBay to get them to remove the fake seller.

Summary and Conclusions

Look at the seller's payment procedures

Look at the seller's feedback and ask yourself whether it makes sense.

Look at what they have bought and sold - can they possibly have the items they are offering for sale? If they have more than one of a rare item, they are almost certainly crooked

Ignore one-day listings

Ignore offers with unnecessary and cheap Buy It Now options

Look at the background of the bidders. As a general rule the experienced ones can spot these frauds

Do a search for the item on eBay - they are often still available for sale from the real seller

Contact previous buyers to check out the seller

Ask the seller for new pictures of the item or items for sale

Simply, do not buy from new or very low rated Chinese sellers

Help other eBayers by reporting the fraud to eBay and by emailing the unwary bidders

Finally, you can get bargains on eBay but ask yourself whether the bargain makes any sense to you before you part with your money.

He complained about the charges but later came around when
I explained to him the complexities of the task he was
asking of us. I undertook all the processes and made sure I
followed his precise Instructions to the letter and had the
Funds deposited at the Cape town based Security Consultancy
firm, Mr. Dudley Roy told me he wanted the money there in
anticipation of his arrival from Beirut later that week.
This was the last communication we had, this transpired
around 11th February 2005, we got a call from the security
firm informing us about The inactivity of that particular
portfolios. This was an astounding position as far as I am
concerned; given the fact that I managed the private
banking sector I was the only one Who knew about the
deposit at Cape Town based Security Firm and I could not
understand Why Mr. Dudley had not come forward to claim his
deposit.

I made futile efforts to locate Mr. Dudley no success, one
weeks later, information started to trickle in, apparently

description was declared dead in Beirut bomb blast that

this transaction. I have investigated all the areas
regarding this deal and perfected every internal
arrangement to see that the deal will

don?t want to disclose this transaction with anybody here
in South Africa.

Before proceeding, I would like to re-assure you of the
risk-free of this transaction, this transaction have been
carefully drafted in such a way that it will not harm both
of us in any way or destroy our personality during and
after. All I need from you is 100% assurance that you will
not disappoint us after receiving the money into your bank
account.

This money does not originate from any form of Drug or
Terrorist activities and it will not attract such or any
questions from any authority when transferred into your
Bank account, all the documents will be arranged perfectly
by us down here as already
been worked it out already.

The first thing I checked was their alleged company's address: Jl.
Jend. Sudirman 453B, Yogyakarta 55223. This address is fake. First,
because the correct post code for all houses in that street with
numbers 38 and higher is 55224, not 55223. Second, because there is no
house number 453B in the Jenderal Sudriman Street in Yogyakarta. The
numbers in that street don't go further than to the 80s. A company
that provides a fake address on their website can't be trusted.

And there is more: They registered their Web domain using the same
fake address (completely omitting the post code), and with an equally
fake telephone number: +001.81332777258. The +001 would be the country
code of the USA or Canada. That is, of course, more than unlikely for
an Indonesian company. And the number behind the country code does not
even comply with North American telephone number schemes, it has one
digit too much.

Furthermore, the domain was registered only on 24 June 2006, and will
already expire on 24 June 2007, after just one year. Since this
"company" claims to exist since 2004, it would mean that they waited
for 2 years before they registered their domain, which is very hard to
believe. Again, this is one of the typical short-lived, "disposable"
domains scammers usually register for their fraudulent activities.

By the way, "Co. Ltd." is not a valid Indonesian legal form of a
company. It was certainly chosen to impress potential victims from
English-speaking countries, who are obviously the target group for
this scam.

I recommend not to trust Renzo Electronic and not to do any business with them.

I have the firm impression that this company is a scam. Checking
Chinese fraud companies is very hard due to the lack of companies
registers and similar sources. But fortunately, Chinese scams are
often enough very obvious, clumsy and primitve.

In this particular case, the first thing I did was to examine what
this "company" claims to be on their website. The result is very
interesting:

- They claim that their company "...was set up in 2002", and that by
now, "Our business is successfully expanded to United States, Canada,
United Kingdom, Italy, Germany, Brazil and so on." However, in those
alleged 4 years of repordtedly very successful existence, the company
failed almost completely to leave any marks on the Internet. A Google
search for them revealed that they are only mentioned at two places:
EC Plaza and Echinatex. Both sites are just business-to-business
marketplaces where companies are not checked for being legit. In fact,
those and similar sites are where scammers with fake companies prefer
to gather to find their victims. The fact is that it is more than
unbelievable that this "company" has been existing for 4 years now.
Rather, I'd say that this fake business is just some months old. And
this leads to #2 of my investigation:

- I checked the ownership record of their Web domain, "goodshoes.net".
Chinese domain registration providers are infamous for allowing their
customers to register domains with very incomplete identification
(which makes China a paradise for online scammers), but this record is
even less then fragmentary:

This most important part of the registration record for
"goodshoes.net" tells us absolutely nothing. Anyone could be the owner
of this domain. And it is obvious that whoever registered the domain
wanted to remain as anonymous as only possible. This leads to the
question: Why would a reputable company do this? This behaviour is
typical for scammers who don't want to be traceable.

However, there is one interesting part in the registration record. It
tells us that the domain was registered only rather recently, on 20
November 2005. And it will expire after only one year, on 20 November
2006. The fact that this "company" allegedly waited 3 years before
they registered a domain is one thing. The other thing is that this is
typical for scammers: They register "disposable" short-lived domains
which they simply abandon once they are not of use any longer. It is
not what reputable companies do.

- It is also revealing that the only contact information on their
website is this e-mail address: mynike1971@hotmail.com. It is a
Hotmail address which can be registered anonymously and which cannot
be traced back to its owner. Ideal for scammers, and very often used
by them for criminal purposes.

- Finally, they insist on payment via Western Union, MoneyGram or
Telegraphic Transfer. This is very typical for scammers since once the
fraud has been detected, it is impossible to ever find out who
actually received the money or to call back the transfer. Reputable
companies don't insist on these payment methods but offer other, more
trustworthy alternatives.

All in all, Naotone Shiyi Houschold Textile Co. Ltd. appears not to be
trustworthy. I recommend not to do any business with them.

I have reasons to suspect that this company is actually a scam. I
can't, unfortunatly, check the certificate they sent you (though I
have no doubt it is a fake; I have already encountered several
Indonesian scammers faking any kind of documents to appear legal). But
there are other points of interest:

- They seem not even to know their own address. The information they
gave you says they are located in the Duta Mas division of Batam, post
code 29422, which is also what they used for registering their Web
domain. At the business-to-business marketplace Alibaba, they claim
that the post code is 29426. Actually, none of those two post codes
belongs to their street address. If a company uses fake addresses, for
whatever purpose, it is always a bad sign and not exactly proof of
trustworthiness.
By the way, at AllProducts, another marketplace website, they even say
that they are located in Padang, a completely different town.

- There used to be a now-defunct local computer shop in Batam, with a
rather similar name: "Digdaya Komputindo". Their address was a bit
different (Bloc C-4/1 instead of B-4/1). The unimaginative scammers
only slightly changed the name and the address for their fraud.

- They registered their domain for only one year, from 29 May 2006 to
29 May 2007. While such short-lived domains would be most unusual for
reputable companies, they are typical for scammers. By the way, they
have not even managed to set up a working website. Such unbelievable
carelessness would be deadly for a real company.

- And, which is most revealing: There is no company of the name
"Digdaya Computindo PT" listed in the official Indonesian register of
companies.

I can only recommend not to trust this "company".

MONEY SCAMS: How to avoid getting ripped off

Scams take many forms: overseas lotteries, get-rich-quick schemes, work-from-home jobs and hundreds more, but the fact is that unless you've been ripped off in the past you probably don't know how to recognise a scam when you see one.

The people who design the scams are clever. Most scams look like the real thing and they appear to meet your need or desire. They often piggy-back off the reputation of schemes which are proven to be legitimate, for example, not all lotteries are fake, not all work-from-home schemes are rip offs. Unfortunately it can be extremely hard to tell the difference…so let's commence your education!

Firstly, let me clear up a couple of myths. Many people hold the belief that every business is OK because they are all vetted by some kind of government authority. This is false. While government agencies in Australia and most other developed nations work hard to shut down illegal scams, the scammers might rip off hundreds people before they are caught.

Another dangerous myth is that there are quick short cuts to "getting rich". People claiming to be millionaires regularly hold seminars or write e-books to explain how you can make a fortune by simply following their advice: perhaps it's a secret stock market plan, a way to make millions with real estate you don't own, or participating in online surveys from your own home computer.

Do any of the above scams sound familiar? You probably see them on the internet all the time. Ask yourself: if a person knew the secret to instant wealth, would they want everyone in the world to find out about it? And if they're already a millionaire, why would they spend all their time telling people about it…and why would they need to charge people money for it?

Keep in mind, however, that not all scammers go for the "get rich quick" headline. Some will entice you with a smaller but equally attractive proposition: the opportunity to quit your day job and earn the same money by working part-time from home. These scams run rampant on the internet and often start by only requesting a small outlay, of say $40 for which they will send you an e-book containing the secrets of wealth.

You might be thinking, "I'm willing to gamble $40 for the possibility of never having to work again! It's worth it." Once you hand over the $40 any number of things may then happen:

(a) You get nothing and never hear from them again
(b) You get information via email that is of little assistance
(c) Worse than that, they may start harassing you for more money, trying to convince you to "upgrade" to the next step or pay some kind of taxes or freight cost (telling you that you'll earn the really big dollars if you just pay them a little more). This cycle can go on forever and under the infamous "Nigerian Letter Scheme" people have been ripped off for tens of thousands of dollars.
(d) They may pressure you into giving them your bank account or credit card details for some seemingly legitimate purpose, e.g. to deposit funds into your account, or to keep your credit card details as "security".

Here is the shortlist of the most common scams to avoid:
· Overseas Lottery - an unsolicited letter, call or email telling you that you've won cash or prizes in a Sweepstakes or Lottery you did not enter.
· Chain Letters
· Pyramid Schemes - a business proposition where you pay a "joining fee" and the main activity is the recruitment of new members. These are illegal in Australia but some people will try to convince you that their scheme is not illegal because they have included some kind of dummy product that is changing hands.
· Ring Tone Scams - you might be attracted to an offer for a free or low cost Mobile Phone ring tone, but what you may not realise is that by accepting the offer you are actually subscribing to a service that will keep sending you ring tones - and charging you a premium rate. (e.g. $10 per week subscription fee) There are legitimate companies selling ring tones, but there are also scammers who will try to hide the true cost of taking up the offer.

Of course, there are many more. Too many for me to list here!

The golden rule is: "If it sounds too good to be true, it probably is." Now I know that this is a pretty negative mantra - those "positive thinking" and "life management" coaches would have a heart-attack if they heard me preaching such negativity! But they are not thinking about your best financial interests.

Here is how you should react if you receive a suspicious offer:
· In person: Say NO THANKS and walk away
· Via Phone: Say NO THANKS and hang up the phone immediately
· Via email: Delete the email immediately and don't click on any links
· Via post: Throw it away

If you are concerned about saying no because you think the offer could be legitimate, consider the following course of action.

Be especially wary of a salesperson that tells you that "you must take up the offer today". If the offer is legitimate, there's no reason the salesperson cannot give you some information to take home and examine at your leisure. If the offer comes from a Telemarketer, they should be happy to post you some information or give you a return phone number so that you can call back if you are interested at a later date.

Still interested in the offer? Log on to the Australian Government's Scam Watch website: www.scamwatch.gov.au (or other governmental "fair trading" website relevant to your location). This is actually an excellent website for anyone around the world and will help you identify whether the offer is a known scam.

OK, if you are still convinced that the offer is not a scam, then write down any questions you have. Take a friend or relative with you when you talk to the salesperson again (preferably the toughest, most analytical, least-easy-to-impress person you know!). Make sure you are completely satisfied with the answers to all of your questions and get everything in writing.

I'm not saying that every opportunity is really a scam. There are many legitimate lotteries, employment and investment opportunities out there.

If you come across a great investment, good for you! By completing all of the above steps you are doing your research - something EVERY investor should do.

Now I will give you some solutions you can choose from. But, unfortunately, all of them have some bad consequences, aside the good ones. The best piece of advice anyone that makes money online can give you is testing.

First, the obvious solution: get rid of the refund policy. This way you won't have problems with these scammers anymore and you can continue to make money online without them bothering you. The bad thing is that this solution might reduce your conversion rate, but like I said before, test. In 2005 the UK's Office of Fair Trading (OFT) launched a campaign in order to raise awareness of the most common ways in which people are conned. The OFT identified the top ten scams targeted at UK consumers.

WORK-AT-HOME SCAMS

The person at the top of the list receives their gift only after a predetermined number of new buyers sign up. The victims are usually encourage to hasten he process along by introducng their friends and family to the scheme. The large majority of people on the list never receive the prize.

PRIZE DRAW MAILINGS
The victim receives a notification by post that they have won a prize such as a holiday or a sweepstake draw. In order to receive the pize an administration fee or registration fee must be paid in advance. Once this is paid the prize will fail to materialise.

PROPERTY INVESTMENT SCHEMES
Potential investors attend a free presentation, the purpose of which is to persuade them to pay large amounts of money to enrol on a course which promises to make them a successful property dealer. Some schemes involve the offer of buying as yet unbuilt properties at a discount.

Others involve a buy-to-let scheme where the scammers offer to source, renovate and manage existing properties which they claim will provide good returns from rental income. The properties are often derelict and the tenants do not exist.

PREMIUM RATE TELEPHONE NUMBER SCAMS
The victim receives a notification in the post that they have won a prize - a holiday or a sweepstake. In order to claim the prize they need to call a premium rate number - usually beginning with 090 - which will incur high charges. Ofen there is a long recorded message and the prize simply does not exist.

INVESTMENT-RELATED SCAMS
The victim receives an unsolicited telephone call which offers the opportunity to invest in rare commodities such as diamonds, fine wines or shares. These investments are usually in areas which carry a high risk and where a high level of training, skill and experience is normally required.

The shares are not quoted on any conventional stock exchange. The diamonds, if they exist and are actually supplied, will be low grade and worth considerably less than the amount invested.

NIGERIAN ADVANCE FEE FRAUDS
This form of fraud has been around for many years. Many of the earlier scams originated from Nigeria, hence the name, but today similar variations can be seen from Iraq, Asia, Africa etc. The main requirement seems to be that the area should have recently had a war or some major political upheaval.

Today this type of fraud is mainly perpetrated via e-mail, but some traditionalist scammers may still use letters by post. The victim receives offer to share a large sum of money in return for using the recipient's bank account to transfer of the money out of the country. If bank account details are rovided, the scammers may empty the victim's account. Alternatively, the scammers may ask for money up front - usually for bribing corrupt officials in order to get the money out of the country.

CREDIT SCAMS
Another advance fee fraud, which often originates in Canada. Adverts are placed in local newspapers offering quick loans, even if the applicant has poor credit history. Applicants are told thattheir loans have been approved but they must pay an insurance fee prior to release. After the fee is paid, the victim will never hear from the scammers again and the loan amount will never be advanced.

PYRAMID SCHEMES
Pyramid schemes, sometimes called Ponzi schemes, offer a return on a financial investment which is based upon the scheme continuing to grow as new members join the scheme. The money from new investors is used to pay earlier investors - robbing Peter to pay Paul.

After a while the pyramid will collapse as it reaches the point where there are not enough new victims entering to pay off the earlier investors.

It's worthwhile to examine Google's definition of Google AdSense and Click Fraud , before delving deeper into "AdSense Fraud" .

Google AdSense fraud is one of the diseases that plague the Ad Words advertisers. The AdSense program essentially allows website publishers/owners to sign up with Google, enabling them to display Google Ads on their sites. These publishers essentially act as "Google Partners". The ads chosen by the Google bot for display are contextual and the ads are related to the contents of the publisher's website, more specifically that particular web page. The intent for Google is to capitalize on the traffic to these (in practice) niche sites and provide highly direct targeted traffic to the advertiser. A subset of the users of the Google Partner website, click on those ads and Google charges the advertiser per click. Google shares the booty with the website publisher but the revenue sharing ratio falls under Google's "undisclosed "criteria. While the exact amount can be reverse engineered, the take home lesson is that the final amount is proportional to Google's income from that click.
In theory it's a match made in heaven. The advertiser gets good ROI through targeted traffic, the publisher gets to monetize the traffic on their website and the web browser gets to buy that classic CD that he couldn't live without. Not to mention that Google gets a wad of cash. The gods of lucre smile beneficently on all.

Unfortunately, this happy façade hides blemishes. Severe ones. For all Google AdSense Publishers are not created equal. While (we daresay) many advertisers have a genuine website, providing a valuable or interesting service to the world wide community, there is a significant number of unscrupulous operators who are out there to prey on the advertisers. These creatures of the night (and we will explain later why we use that term), make websites for the express purpose of milking AdSense revenue.

This category of fraudsters deserves a taxonomy of its own, which we have developed (the other categories, click fraud and impression fraud are even bigger problems in some industries). In the interest of not being gender biased, we have alternated between genders. We hope that our lighthearted tone does not mask the revulsion that we feel towards these cheats.

Regressive Fraudster ( aka ClickMonkey ):

This guy is at the bottom of the food chain. Inspired by the riches of his neighbor Ms. Jones, who has been making more than ten grand a month in AdSense revenue, he plans a course of action. He "invests" in a clickbot software( a simple google search reveals many) and gets a list of anonymous proxy addresses. He then goes to register a few domains and hires someone off of elance to create a "network of sites"and " click bot " . He hopes that the interlinked sites will provide each some "link popularity" and increase his page rank. If only it were that simple! He then proceeds to use the 30 dollar clickbot to start clicking on the sites. Or he could click on them himself manually using the proxies. We don't call him click monkey for nothing. He clicks and clicks all the way to see his account getting banned. No banana for this monkey! His calls of despair to google fall on deaf ears. This person is likely to quit, but sometimes retries to get up the food chain, the Wanna -Be-Fraudster.

Wanna -Be Fraudster ( aka BOZO):

This girl searches for high paying keywords like "home loan equity" (current ad words rate: 45 dollar), or "web hosting" (ad words costing 20 dollar). She correctly guesses that the AdSense payout is proportional to what Google earns and therefore homes in on such words. Her strategy is to make a page with contents that are appropriate for the targeted high payout keyword. She moves ahead by clicking on the link multiple times and recruits friends and family to give them a click. Or ten!

Little does she know that Google has a 45 day inspection period before she get her nubby little fingers on that cash. With little to no knowledge of Click through Ratio , her greed couples with her ignorance. Seeing her ill-gotten paper wealth multiplying in her AdSense interface, she increases the clicks. Google however inspects the CTR and throws a fit when they see a CTR exceeding 20%. Furthermore, Google notices clicks mostly originating from a few IP addresses and that essentially seals her fate (or rather docks her earnings). That virtual cash is now just some deleted bytes on a hard disk on Google's servers. She moans, nay she rail against the cruelty of Google's policy. Some of these people wisely cease and desist such activities, perhaps philosophizing about the NFL (no free lunch) theorem. Others however see it as ground school for the next stage of nefarious behavior. The Almost-There Fraudster.

Almost-There Fraudster ( aka SmartAlec ):

The archetypical ATF is supremely confident in his ability to fool Google. Like the BOZO, he looks for high paying keywords and makes appropriate website(s). Let's assume that he is in a third world country, just to make the case more interesting. The case described here is 1 year old news. He has read this article and taken the learnt the subsequent lesson . He knows that that the clicks from the IP Addresses of USA, UK & Canada are worth much more than the clicks from the IP Addresses from the third world countries. He therefore seeks to befriend people from such IP addresses by logging onto messenger services.

This way, he gets the unique, unrelated IP clicks and (he hopes) that Google is fooled. Remember "creature of the night". Well, these people typically are more than a few time zone removed from the US or Canada and therefore are up at odd hours whenever they feel that their targets are most likely to be active. Plus they sometimes have to deal with "inconveniences" like a day job.

AT fraud thinks that the clicks he obtained by trolling on these sites is a job well done. He has got clicks from the IP address of his choice .. An interesting factoid is that for AdSense, state also matters. Clicks from Washington and New York State have the highest payout for AdSense Fraud.

He has just one problem. His tragic flaw. While he worked so hard to get the unique IP and high earnings, he is not able to maintain a good CTR. He is likely to cross the limit of 30-40% of daily CTR and 10-20% of overall CTR. He ends up in the same purgatory as the BOZO. The account is banned, and he gets the abominated email. Yes, the "AdSense account closure". Almost-There is never good enough in this nether world of AdSense gaming. Although it is possible that he would have made a few thousand dollars before the punishment catches up to his crime. Crime doesn't quite pay, now does it? Well, gentle reader, unfortunately crime _is_ paying to the next category. Fraudster Maestro ( aka Satan's Spawn).

Fraudster Maestro ( aka Satan's Spawn):

This category of fraudsters is the most sophisticated and rarely gets caught by google . She has researched the high paying keywords as well as the CTR issues well. She has the smoothest lines in the business of soliciting clicks. She can flirt online, and ask to click the "link" for her picture. Or she may claim that clicking the link causes the hungry child to be fed in Ethiopia . Let's follow a typical "simple" chat session:

And she has lots of tricks up her repertoire besides chatting up strangers. She knows about opt in lists, usenet and blogs where she can snare the victims. Technically savvy and able to empathize with her victims she doesn't let arrogance get in her way to success. Since she is very mindful of the CTR issues she has a secret weapon. She has optimized her site for some low paying keywords which are really not competitive. She organically gets lots of traffic (but for things unrelated to those competitive high paying keywords). In her website, she may be giving away free greeting cards Or free screensavers. End result is a fabulous impression count. The second step for her is to makes unrelated pages on the same site and these pages pertain to the high paying keywords. These keywords are used to attract the victims of chat sessions. Some things you can do to stay ahead of the game. This is by NO means an exhaustive list, but it's a start. It's sorted by the level of protection in ascending that you may need.

1> Let your visitors know that you are tracking them and know quite a bit about them. For instance, if you visit www.sofizar.com , you will see information about yourself. You can display this information to all your visitors, or only to some of them. It can be in-your-face or subtle, but it will remind at least some of the fraudsters that they are being watched. Sofizar provides free sample code and connection to its database allowing you to display "premium" information(like City, ISP, ISP contact number).

2> Invest in a serious visitor tracking software. Set alarms based on the number of times a person clicks on your site in a certain time period(hourly, weekly, monthly). Display the same information to someone who is definitely PPCing your budget to death, as a custom message box. Something harsh, if the pattern keeps up. "We are logging the usage, and we are noticing that you keep clicking on our site through PPC. If you don't cease, we would be forced to call your local ISP at +91-23-344-5678"(if you see the information that we can glean about visitors, you will know we can get even more specific). This will weed some of the casual fraudsters.

3> Start checking for things that we have discussed earlier, by investing in an industrial strength data collection package. Based on your data collection, one strategy is to score each visitor, deducting(or adding points), based on the following (non exhaustive) list.

a. Visitor conversion/past conversion history.

b. Visit Depth Analysis.

c. Visit Time Analysis(time spent on each page, and time of day the visit happens).

d. Cookies/Javascript/"Unknown OS"

e. Keyword Cost analysis.

f. Anonymous Proxy Server

g. Is part of "Fraudster list".

h. Country/Localization analysis(are you really targeting people in Sao Paolo , Brazil for your French Restaurant in New York ?).

4> Do pattern matching. See what your top 20% of your customers do as part of a "macro pattern" and match the visitor against that pattern.

Keep in mind that you will get a few "false positives" and vice versa. A few innocent people may get tagged unfairly as "fraudsters" while a few "fraudsters" may well give you the slip. It's not an exact science, but over a period of time you can get fairly close. If you decide to take up your case with Google, you have to make a very convincing case. All based on meticulous data, instead of (what may be considered by them as) paranoia.

Transneft fee scam from Russian Oil Sellers

To all buyers of Russian Oil Products:

Do not pay any upfront Transneft fee to Russian Sellers under no circumstances.

There is a well Russian organized crime network made of many so called Russian sellers or seller's mandates, most advertising on Alibaba.com.

Their contracts usually include Cell phone as seller's phone, fake bank account, fake SWIFT code, fake email addresses, fake bank officer who is usually an individual who is part of a scam.

All phone and email messages that the buyer sends to the seller's bank go to people working for the scam not to the bank.

Some of these companies are fictitious and do not even legally exist.

When they provide Transneft invoice and other documents, if you ask for verification, they will put you in contact with Transneft officials including the President of Transneft. These people are also part of the scam and no really who they claim to be.

They used to provide an invoice for payment to be wired to Alfa Bank in behalf of Transneft pipeline. They have people inside Alfa Bank to divert the money to them.

Nowadays, they use Russian Standard Bank with the money going to an individual who supposes to be a Transneft Trustee but is part of the gang.

The following companies are part of the scam: Alduke Holdings-Sibneftprom, Soyuz Corporation, Igion Oil, Icon oil & Gas, Rusneftprom, Zorin Energy Resources. Avoid individuals like Nikolai Gubin from Alduke Holdings, Andrei Shaika from Soyuz Corp and Rusneftprom.

They will object to you visiting MOscow to personally make payment to Transneft Bank then move to LC in exchange for PB/POP documents there.

No matter what you do, do not pay them upfront fees and do not accept any procedure where you have to pay large upfront sum to get the deal started.

Things to do to avoid these scams:

1.- Always contact your country's embassy in Moscow for help on screening Russian sellers.

2.- Ask your embassy to recommend a local lawyer to screen and verify any document that you receive from Moscow.

3.- Get your lawyer to invite you to Moscow to verify all documents issued by your seller and to visit your seller.

4.- Get the seller to move first by issuing PB from reputable Russian Bank with a major Foreign corresponding bank and Vessel Charter Party Agreement verifiable through your lawyer in Moscow. There is no scam without a Bank. Check the seller's bank listed on the contract. Bank uses their own mail server so if given bank email address shows a different mail server then be concerned. Call the bank. Bank officer should use a land line for their phone number not cell phone

Serious and sucessful sellers should not have any need to collect Transneft fees upfront from you once you show then preliminary proof of fund via BCL or soft probe. Only scammers want to see your money first, because their business is to collect these fees,not to sell oil. Furthermore, once you send them one payment, they tell you that they have a quota and that you need to send them more deals before they can accept your Pre-advice LC or issue PB. Even if you ask them to sign a promisory note to return the money in case of non-performance, they will do it because you have no way of collecting that money back from them. Do not accept any document from these people unless you have a way of verifying it independently. They are master forgeurs for all sort of refinery and government documents. Happy Trading !!!

2. Too Good To Be True Rule - If you think the order is just too sweet - it is!

3. Travel Demand - When a company refuses to close a deal if you don't travel to them to sign then something is wrong. We sell worldwide and the opposite is usually the case. If someone purchases from you they want to come and see where YOU manufacture - not the other way around. EVEN if they are Chinese...

4. Check All Credentials: Import License, Business Certificate, Ask for trade references.

5. NEVER make any sort of payment. No discussion until the initial payment is made and always as a wire transfer.

Copper cathode - Spot the Fraud

1. 914mm x 914mm x 12mm cathodes are not produced by any refinery on this planet

2. The DRC does not produce 99.99% cathodes

3. The DRC only produces 500mt a month through Somika and Gecamine. These facts are openly available on the internet

4. Copper cathodes are never sold in ports

5. Tanzania does not produce copper

6. Pictures of copper should reveal the white paint markings. This leads you back to the producer. A simple email to the security wing of the mine will tell you who the copper really belongs to

7. Copper is never sold at fixed prices

8. Copper is not sold at discounts from Africa. The real price is LME + $160 CIF

9. No copper is sold FOB

10. No Copper is sold FOB port.

11. Mines sell copper CIF as the responsibility is on them to deliver

12 No mines offer performance bonds. There are no mining contract on this planet that offer this brokers and scammers ploy

13. SGS do not do cathode inspections in any African port

14. Inspection in port- You will see MCM and KCM copper being loaded on a ship and end up paying your BG or TT for nothing

15. Unless your name is Samsung, LG or Pirelli you are not going to get a contract for anything over 1500mt a month.

16. Chinese buyers will not buy cathodes when their SME subsidises local copper sales. The SME copper is less than the LME price, so why would they buy premium price copper?

17. Brokers.....and you are all brokers and not sellers or mandates. There is not a mine on this planet that sells copper through brokers and pays them commissions.

18. If you are offered a commission to sell copper you are being offered a commission to participate in a scam. If it is a scam, do you think they are going to pay you a commission having such scruples?

19. Mines accept offers for their copper. They do not issue soft offers and full corporate offers.

20. Non LME copper is 99.96% and less and referred to as B Grade or PQ grade. The difference in price ranges from 2 - 7 % and not $3000 as these scammers have you beli

I dealt with this company once and everything went ok,i got my items a little slow but i got them.
This time a few months later i purchased some items. it took a week to get a tracking #. then after another week it still doesnt work. then i was told some BS I was taken with the same line almost of of us have. the items we taken by Chinese customs. NOT TRUE. per our orginal argreement they will re-send so i asked he said"maybe".

First off Alibaba.com is not a scam!!!! This is a B2B Marketing web site. China Suppliers and Trust Pass Members pay a fee for the ability to ADVERTISE on this site. This is not Ebay its not Taobao. There are no auctions here.

The scam has been around since man realized that there were greedy, not informed, not schooled, other human beings that were looking for something for nothing. We hear about email scams, lottery scams, and business scams. What is the single most thing that entices people to respond to these scams? MONEY - In the form of something for nothing or almost nothing.

Rule of thumb - If its to good to be true, IT IS.

Every product made has a minimum cost to produce. If you don't have a clue about a product or service you want to buy how can you make an informed decision?

EXAMPLE: Apple has been successful for many years. They come out with the iPod it costs X amount of dollars to produce. However to make money they must mass produce the item. They mark up the item 20-30% for sale on their own sites which becomes the MSRP. However, in order to market them around the world they sell them to authorized distributors for a 50% discount on the MSRP mark-up who in turn sells them to retailers or VAR's (Value Added Re-sellers) for a price around 7-12% of MSRP depending on quantities ordered. If you follow this progression of formula's you would find that a retailer would be making about 7-15USD on each 4GB iPOD they sold. Here again they are not making vast amounts of money from selling 1 or 2 but because they are selling hundreds. Also its a clear fact that most of them oney made in electronic's is on the accessories not the actual products themselves. Like replacement headphones docking stations, iPod surround sound.

This process is followed by all companies with Brand names that have no self distribution. Therefore if you see Name Brand items advertised for more than 10-15% off MSRP price you need to be highly suspect of the seller and exhaust all avenues in completing "Due Diligence".

STOPPING THEM

1.) Eliminate the greed in yourself.
2.) Be informed, know the product.
3.) Exhaust the available resources for confirming trade partners.
4.) Never do first time deals via the internet alone.
5.) Get a pre-shippment inspection done by a reputable service.
6.) Don't pay until you recieve the inspection. If they want 30% in advance tell them you need a factory audit first.

Inspections are honored by real suppliers and manufacturer's it also sends them a signal that you are a serious buyer. Lastly understand that you can not buy a branded product from anyone other than the manufacturer or factory authorized distributors and VAR's

New ways to identify scammers. 7 advices

This is how I normally do to identify scammers, with this, you should be ok for quite some time.

First of all, I do Google search with the name of the company and the word scam. Normally, there should be no page with the company listed with the word scam next to them but if you see at least one, maybe it is a scam. No need to have several pages, only one is neccessary.

Secondly, I go on a very good website, http://fraudchina.blogspot.com who have a list of all website and company listed as scam. They just saved me from sending sample to a scam company.

And thirdly, just ask people around on forums. I saw a mate who've done that.

Fourth steps is that you can verify the address they gave you and find out what's really on this. Go on www.whitepages.com and enter the address they gave you to find out if the address is really registered as their business address or at least at their names.

Fifth test is to ask them to phone you. Normally scammers won't do this but beware, some also tries to call you. Please be aware that some scammers uses call redirection which is call callback (I'm not sure of that) or they can use fax to email. Using this, they get number that are listed in U.S.A., U.K. or any European country where in reality, they are located elsewhere.

Sixth, always inquire about the mail address. This is a mistake scammers often made. Try to see whether the email address comes from a free mail server. Suppose you get a mail from economicdevelopment@mail2cameroon.cc, be sure this is a scam. The mail address (it truely exist and they tried to scam me) is not from the Cameroon government, but from a free mail server. This is how I caught my first scammer.

Seventh and last advice for the time being; JUST COME AND ASK ME. Yes, you can come and ask me and I'll help you. I've been for so much time victim of scammer, who fortunately failed in their attempts, that I've got some pretty much experience.

This is approximately all I can remember for the time being but again, if you need advices, feel free to contact me.

Everybody is writing about not trusting suppliers from China – what is exactly the problem? I have had good relationship with China suppliers but I am dying to know the details of the problems others experience –I might be able to help.

These are the problems and personal suggestions I have for the Chinese suppliers:

1. Oversupply - too many manufacturers and suppliers of the same product, causing gluts in supply, high competitiion and a downward pressure on price, compromising the quality of the product.

2. Fragmentation - the manufacturers of the various SEZ need cohesiion and unity, to share information with each other, to work in cooperation and compliment each other.

3. Brand names - China has short history of International brand names.

4. Advertisements - China has conservative ideas about propagating and soft selling their products. Spendings on marketing promotion, and working with US models can help to improve this weakness.

5. After-sales service - International warranty coverage and distribution network has rooms to improve.

6. Shipping and logistic systems has yet to realize to world class.

7. IP law and copyright regulations has to be enforced 100%, especially on software piracy and counterfeit brands.

8. Payment terms need to improve. Work with financial institutions and build up two-way trusts. Due deligence by third party has to be available for big transactions.

9. Transparency. Published company profile, lists of directors and shareholders, account report briefs, and track records have to be current, comprehensive and authenticated.

10. Technology and innovation. The interim measure is to work with imported technology, get licensing from brand names and to foster links between industries and technogy institutions and universities in the country. The long term solution is to have Research and Development centres to the different groups.

How can you import authentic NOKIA mobile phones from China?

It's strange that there are many Chinese Gold or Trustpass at Alibaba.com members claiming that they can export authentic NOKIA mobile phones in China. I called the sole/exclusive NOKIA manufacturer and distributor in China www.nokia.com.cn ( free call: 4008800123 ) and I was told that authentic NOKIA are not allowed to export to other countries at low prices. IN this case, how can you import real NOKIA from China with low prices? There must be something wrong. As far as I know, there are some small trading companies in Shenzhen, Guangzhou or Beijing processing some used NOKIA or second-hand Nokia series and labelled again and resell to other countries as brand-new NOKIA. Please be careful, everybody. You have to know where their factory is located exactly in China when you import such branded products from China, of couse, a Pre-shipment Inspection or a Factory Inspection is very necessary when your order is large enough.

Whilst not technically a scam as this company did eventually ship the
ordered product to us, I am posting this message as a warning for anyone
buying products from this company.

This company, although assuring us that they were a genuine quality
manufacturer, CE ISO etc and of course are trustpass & gold members, shipped
memory cards to us that were re-blown cards repackaged as Kingston Sandisk
etc.

They send me the different kind of card from what I ordered, the worst thing
is they sent me the VERY POOR QUALITY, HALF CAPACITY products...The 1gb
cards were actually 512mb, the 2gb were 1gb and even one batch of supposed
Sandisk 2GB SD/CF cards were actually 512mb. This of course was easy to spot
as they had simply blacked out the printing underneath which can be easily
read through the new printing.

I was trying to contact the sales person (Arnold), he blocked my messenger
and trade manager. I called to their company in China, even the boss name
(Coco Xiao) is very rude. First she told me that Arnold is working in the
other company, so there nothing she can do, how could she say that as that
her company. After that, I called again, this time the other sales person
(Joey) said Arnold is not working there.

After that Joey ask me to return back her items for exchange, I sent back
some of them, but after 1 month later I received the cards back, the cards
she sent back to me are exactly same with the card I sent to her, she only
change the sticker, the card is not working, some have half capacity, all I
can say is VERY POOR quality products. I sent the card back to them and
since then they just ignored me and never sent back the item back to me.
Because of they products, all my customer complaint and ruined my company
reputation.

Please be advised and I would strongly recommend you to avoid this supplier.

3 out of 3 Gold / Trust Pass Members fail site Inspection

Last week I paid several factory visitations to some Shenzhen-based companies in China upon request of some foreign buyers.

All the three companies are Gold member or Trust pass members in Shenzhen, who all claimed that they were real manufacturers of electronics in China. I’m sure most of the foreign businessmen will be astonished at the result of my visitation in Shenzhen; here is the basic information from my visitation report:

Company One:
Declined my visitation on the pretext of goods shortage, but they promised to receive us before our departure to Shenzhen.

Company Two:
Received us at an office in a Hotel, there are 3 salespersons working in the office. We cannot even find a Logo on their company in the office and on the door. They are checked out to be a small offshore trading company in China.

Company Three:
This is the best one among the three. They are a registered small trading company in China, however, they do not have their own right to export ( I mean they do not have the Certificate of Import & Export issued by local government authorities ), they normally export their goods via Freight Forwarders, for which the buyer may bear some risks.

They registered only on 2005.08.26; however, they claimed themselves they registered in 1999 online. They do not have any factories at all. They cannot show me any quality control measures and after sale services in written forms; they cannot even show me a formal sales contract!!

My suggestion:

You’d better deal with larger trading companies or manufacturers directly for sake of better quality control in China. Lot of trading companies disguise to be a real manufacturer in China, so a factory visitation or inspection is very necessary for a large order in China! A factory visitation can tell you everything about the supplier and it’s one of the best way to verify your Chinese supplier!

What can a factory visitation performed by a local bring you?
As we all know, there are many false things on the web, which perplex us often when we are going to make a decision. The case is also true with buyers who are going to buy from oversea suppliers. Here I bet a factory visitation (better by a local person) is a second-to-none solution.

1.Genuine or False?
The local person can go and check the company (the potential seller) and all its factory registration information to see if it’s a genuine and serious enterprise. This is the basic thing that any buyer has to do before any sincere cooperation!

2.Production Competence (Throughput)?
The visitor can inquire about the factory’s producing ability (also known as throughput) with the director of Production Department. How much can they produce in a month or a quarter? By learning their production competence, the buyer can avoid the risk of a delayed delivery to some extent.

3.Quality Control?
The visitor can try to get to know the factory’s quality control system with the help from the director of Quality Control Department. He can also get to know more by inspecting their assembly lines or work shops. Good quality is always one of the crucial things that buyers are always pursuing.

4.After-sale Service?
After-sale service is also important for buyers. Here the visitor or inspector can make sure if the factory can offer good and effective after-sale services and also confirm if they can include after-sale services as one clause in the contract? After-sale services can keep you free from some troubles.

5.Export License?
Some suppliers do not really have export license. Here the visitor can check the supplier’s registration information with the local customs to see if it can really export directly to the buyer’s country. This is also one of the factors that can free you from being scammed. Other qualifications of the supplier can also be checked out by a local expert in this field in China.

Sending Money Via Western Union Type Service: A Scam Every Time

There are so many scammers in China, it can be downright hard work trying to find the legitimate ones. So let me give you the best advice I possibly can: I do not care what someone tells you, how many pictures of their "alleged" products they have, as soon as they mention the word "Western Union" or any other type of money wiring, IT IS A SCAM.
These types of services are for

1. People that do not have bank accounts

2. Money as a gift

3. To pay a bill (i.e. car payment).

If you send someone money this way, plan on never getting it back. Legitimate companies will NEVER EVER ask you to pay this way.(Ask yourself, when have you ever bought something from a store, and you "Moneygrammed" your payment for it?) If you need more proof, just browse through this website of hundreds of people that are trying to find ways to get their money back.

This is my recent experience: I was dealing with a company I thought was legit. I checked them out on the internet, and it was an actual electronics company in Hong Kong. However, this guy had a free yahoo address(Why not have an email address from the company?) And when I checked out the IP address from the emails, they were traced to Nigeria. Then when he sent an email stating that method of Payment was Western Union, I knew he was a scammer. Also, the name he said to wire the money to was completely different, a 'Aletor Itua'; When I searched this name, I found endless articles of people being scammed from this same person. For fun, I emailed the scammer, telling him that I won't do Western Union, and recommended Escrow.com. This is the email I received back:

"this is my HONG KONG NATIONAL ID CARD,i have never done this before not even to the most trusted customer i will not send my ID card to that person the reason is that here in HONG KONG anyone could be easily located and arrested wherever you are so everyone here in HONG KONG do not give out there ID CARD but i have decided do this because of what you said in the content of your first mail and you wanted someone who could work with you to achieve success . The person that taught you and gave you all those informations are very correct but i want to inform you that if there are bad people in business there are also good people , 10 bad fruits on a tree does not make the whole fruits on the tree bad i want to assure you of a good deal you just wait and see also i want you to know that western union is not established for bad transaction western union is a legal means , but bad people just want to make it bad also do you know that there have been recent reports of cheat via paypal, escrow mr peter with this email bp20002003@yahoo.co.uk was cheated of about 13,000 dolars via paypal escrow but when he met me today he his happy as he bought goods worth 1800 dollars and he his happy in conclusion it is not method of payment that really matters what matters is the person that you wants to buy from , i have conscience oaky and i have promised myself to be good always and not cheat anyone i want to assure you that you are ina a safe hand just go ahead and send the money right now and give me the MTCN today and i will get back to your email with the FEDEX shipment tracking number today take me for my word i am expecting to hear from you N.B . please please please my national id card i send to you is my life please , i will send your item and also to the second address immediatelly i get the MTCN after you have your items i will require you to inform me . Putian Licheng Footwear Co., Ltd. also known as www.sanhots.com is a scammer. I ordered from them before and they sent the goods and one of the hoodies had a broken zipper so I told the person I was dealing with (Sue). Then when it came time to dispatch my 2nd order she said she did it and gave me tracking #. I checked tracking # and there was no record of parcel. Then couple of days later she told me that the package had been detained by Chinese customs. I said ok, and had asked for a refund. She said she would be able to refund only half that amount. Frustrated, I asked why only half? Then she said because its not our fault. Then she just stopped coming on MSN and stopped replying to my emails for a while. Finally, i asked for half of my money back and she didn't even give that back to me. Total money scammed was about $150usd. They are trustpass member on Alibaba.com but aren't trustworthy so don't deal with them. They just stopped replying to emails and blocked me on MSN.

I purchased from www.sanhots.com and did not receive the products. I ordered the last week in February and the salesperson (Sue) is avoiding my contact. I also contacted the manager Cherry who gave me a incorrect tracking number, maybe so it will buy them more time to cheat. Cherry is also avoiding my contact.

They are SCAMMERS.

I’ve make a deal with Natural Sound Enterprise Co Ltd (http://www.nsecom.net ) for buying mp3 player.
Sent money 1228.50$ and confirmed order at 1st February 2007, regarding proforma invoice 30th January 2007.

Because new year holiday , Natural Sound Enterprise Co Ltd have informed us that they will be closed.
After holiday, at 26th February, they have sent email that they haven’t received our transfer.

After informing them that our bank have confirmation, they have accepted that they have received 1187$, but they break our agreement at proforma invoice. They would to change unit price and shipment rate. They have offered to me to send more money or cancel order / send back money.

At 28th February i’ve canceled my order and ask them to send money back. During conversation i was suspicious about their attitude, i have said that i’ll open fraud investigation , contact to consulate, Their answer is ‘ in 2-3 days we send back money’

Today is 7th march still no refund , either a document approving swift have been made.
i’ve opened fraud investigation against this company, i’ve contacted to Istanbul and Ankara China Consulates also Turkish Pekin embassy for complain.

THAT address don't exist!! . there are 25900, went in, checked with the information clerk, she said she doesn't recognize the company's name, and there is no such thing as #25800 on Greenfield Rd.

I called and called that man.... no one ever picks up the phone.

I ordered an item from there website because they take credit card payments instead sending western union and i used a credit card with low limit i use just in case i'm suspicious of a co because there prices was too good to be true....If they charged the right amount they would have got away with it then i had to deal with the credit card co(amount was $410) but they got greedy and tried to charge from 1200 to 2500 from 3 different countries including Sweden and England,i got a call from the credit card co to check if authorized these charges,i canceled the card right then so i got lucky....
If any of you sent western union or any method of payments beside credit card kiss your money goodbye,this co just a front to get your credit card information only don't be taken in by all the award and there trusted seller logo and there elaborate website...ITS ALL FAKE
